Harris County votes November 3 for a county attorney. The candidate listed as the incumbent has never stood for election to the office. She holds it because Commissioners Court appointed her on a 3-2 vote in April, over the objections of the county judge and one commissioner.
Why it matters
The county attorney is the lawyer for Harris County. The office decides which suits the county files, which it settles, and what legal advice Commissioners Court acts on. It has been unsettled for most of two years, and voters get their first say on it since 2020.
By the numbers
- November 3, 2026, the general election. Abbie Kamin, Democrat, faces Jacqueline Lucci Smith, Republican.
- 3-2, the April 16, 2026 Commissioners Court vote appointing Kamin. Rodney Ellis, Lesley Briones and Adrian Garcia voted yes. County Judge Lina Hidalgo and Precinct 3 Commissioner Tom Ramsey voted no.
- June 15, 2026, the day the appointment took effect.
- Twice the office has changed hands since Christian Menefee stepped away to run for the 18th Congressional District seat left by the death of Sylvester Turner. Jonathan Fombonne held it in the interim, then resigned.
- March 3, 2026, the primary. Kamin won the Democratic nomination over Audrie Lawton Evans in a race too close to call on election night. Smith was unopposed on the Republican side.
What the coverage buried
Community Impact’s candidate guide, published September 16, labels Kamin the incumbent. That is accurate and it is incomplete. She is an appointed incumbent, seated by a divided Commissioners Court seven weeks before early voting, and the county judge of her own party voted against her.
Ramsey said at the time, “I don’t think this is the correct way to do this.” Hidalgo objected too. A reader can check both in ABC13’s April story in under a minute.
That detail is not a scandal. It is context a voter guide exists to supply, because “incumbent” ordinarily implies a prior election, and here there was not one.
The other side
Filling a county vacancy by appointment is the lawful, ordinary path in Texas, and Commissioners Court is itself elected. The appointment was always temporary by design, and voters settle it in seven weeks. Kamin also came through a contested primary, so she is not an untested name.
All true, and none of it is the complaint. The complaint is narrower: a guide that tells a voter who the incumbent is should say how the incumbent got there, especially when the vote was 3-2 and the objections came from both parties.
On the substance, Kamin lists going after scammers and slumlords who target seniors, cracking down on domestic abusers, and suing polluters. Smith says she would be proactive rather than reactive, and an independent voice rather than a rubber stamp for Commissioners Court. Both sets of answers are published in full at Community Impact, linked below.
What to watch
- November 3, 2026, election day. Early voting dates are set by the county clerk.
- The 30-day and 8-day pre-election campaign finance reports, which are the first hard look at who is funding each campaign.
- Whether either candidate publishes the office’s current litigation docket, which would let voters judge the office on its actual caseload.
- Whether the March primary’s certified county totals get republished anywhere. Election night and final counts circulated differently.
Bottom line
This is a real race for a real office, and a voter who reads one guide will come away believing the seat has an elected incumbent. It does not. The appointment was legal and the objections to it came from a Democrat and a Republican at the same time, which is usually a sign the question was worth asking.
